iTunes Chart: 5/3/06 DMCA Letter
Mar 06

Ice Age 2Many apologies for the downtime, Apple Legal sent a DMCA to our hosts who then suspended us for most of the morning. We have now removed all mention of the device from MacShrine. I’m sure that you can still find them on mirrors though *hint* Thankfully we can now leave this whole iPod mess behind us and hope another fiasco like this will never happen again, thousands of you must be so confused by all the images coming back and forth! Anyway, thanks for your understanding and we do hope some of you get the joke on the right…

If Apple legal sent a notice does that mean that there is some truth to the iPod AV pics? Or perhaps some ingenious photoshopper simply guessed right!!

  2. Modrak Says:

Hmmm, Apple sent notice - so IT’s true :)

  3. quarus Says:

“Hmmm, Apple sent notice - so IT’s true”

This is want they want us to believe….

  4. SMNMX Says:

It’s not necessarily true just because Apple sent notice. Either they want to reveal such a thing themselves or they’re just ticked off that potential customers are confused and expecting/trying to buy such a product, only to be dissapointed. So, really, there is no proof of anything here.

iPod AV, though. I never heard that name before, and it’s a good one. ;)

  5. Kunal Kapoor Says:

Yeah but if it’s not true then there is nothing illegal about the pics? Tons of people have made images of what people think future Apple products might look like and yet have not been served with DCMA notices. What makes these ones so special!?

  6. ben Says:

the reason apple legal sends notices even if the image is legal is because apple does not want have its costumers mis lead, and people are making images and saying that its “a secret spy shot from apple” and its not or people sayingthat they work for apple when they don’t and this is not legal and its misinformation. Apple has made people remove images in the past that were not what was released like before the imac g5 came out even though the image on the internet turned out to be a white flat screen tv

  7. J.C. Says:

I would be much more inclined to believe the C&D from Apple Legal is true if there was say… a copy of it. That’s just me being cynical but hoping to no end that for Apple’s 30th we get a present.

    ~J.C.

P.S. ~ Does it seem odd to anyone else that the supposed release date for these babies is April Fool’s?

  8. macattacks10 Says:

That may be true that they don’t want to make it misleading, but the past images that were somewhat similar, but fake, weren’t DMCAed… It’s best to wait and see, if it comes out, that’s awesome, if it doesn’t, well the current iPod is still pretty cool

  9. Brad Says:

Jobs and Woz started Apple on an April 1st so flip a coin of whether they’d really release something then or not :-)

  10. Joe B. Says:

Well April Fools is also Apple’s birthday, it was founded April 1st, 1976.

  11. IT: Interesting Tangents » Actual pictures of the next iPod? Says:

[…] Gear Live has pictures (originally posted on MacShrine) of what may very well be the next iPod (you know, the one that’s all screen, I wrote all about it in my last entry). Of course there have been a lot of supposed pictures of it floating around, but these ones have apparently warranted a cease and desist from Apple, which would tend to lend them credibility in my (and most other people’s) book. […]

  12. Xac Says:

was this the image of the iPod with an isight swivel on the top? That’s the only one I could find on a flickr by typing “ipod av image” in google.

  13. SMNMX Says:

Well, yeah the release date is April Fool’s, but so was Apple Computers’ “release date.” Maybe we’ll get some kind of weird, stupid product announced and Steve says “April Fools!” and then releases the real product (iPod AV or not) as a “And one more thing” announcement. It seems logical that there will be a widescreen iPod, whether with a clamshell design or an all in one design or whatever, since Apple is trying to push the idea of an online feature film store, and we’d need a machine designed to view these rather than the iPod 5G which Steve himself said was “iPod with video” as opposed to a video iPod.

  14. SRP Says:

Why would they send a letter only to Macshrine, but leave everybody else alone? I’ve seen these pictures and rumors aon many locations, but you’re the only site with a “cease and desist”???? I find that a little hard to accept at face value…

    Sorry…

    Steve

  15. Chris P. Says:

What exactly is a ‘DCMA’ notice?

I’ve heard of the DMCA, the Digital Millenium Copyright Act, which is detailed at http://en.wikipedia.org/wiki/DMCA

I find it hard you’d be served with a notice under that law, as it outlaws, among other things, breaking encryption of DRM. The law has nothing to do with anything going on here.

Now, a cease and desist letter centered around revealing trade secrets, I could believe. But not a DMCA, er, or as you wrote, DCMA, letter.

Huh, it’s almost like this site is nothing but a sham meant to stir people up…nah, that couldn’t be it.

  16. Adam Says:

Check out this site www.ipodvideowidescreen.com whatcha think?

  17. RC Says:

Good one, DCMA!!! HAhA, almost got me!!!!

  18. joe apple Says:

why not show us the dMca (not dCma) letter? if you don’t already have it, you could ask your host for it… would give this whole story a little more credibility.

the fact that it hasn’t been removed from many other high profile sites makes this whole dmca business a little suspect.

  19. Sol Says:

It looks real. The placement of the virtual Click Wheel on the right makes sense. Anyway, why would Apple Legal send a DCMA if the pictures were fakes? They do not bother to do this with images of fake products.

  20. Dougall Says:

Please, someone, give me a mirror for these pics (or send them to dougallj@gmail.com)

  21. Dougall Says:

Now 1, I get the joke and 2, I get the images from http://guides.macrumors.com/Gallery_of_Video_iPod_Mockups

Anyone who hasn’t already, check that out.

  22. iPanic Says:

Will these sites never learn (inc. MacShrine), no matter if the photos are fake or not, they all describe an Apple product and therefore Apple have every right to demand it be taken off the servers.

If and when Apple do decide to make a new iPod we will all go and buy it and will still worship it. Knowing what it will look like a few months, weeks or hours, is pointless, as we know until Apple announce it it’s not real, and come on they have managed to keep everything so far a secret from us so why bother upsetting them? is it really worth being sued or served notice for removal of the story.

Or are these sites just turning into media circuses and just after hits no matter what the story is.

  23. cp Says:

iPod AV? I’ve been referring to the video iPod by that name for years on forums. I thought Steve would play off iChat AV and (please pleasepllease) include an iSight camera.

I know this is impossible, but I wish the iPod had a visualizer.

  29. raleigh Says:

If I was Steve and I had this much power, I would pull the greatest April Fools Day prank. I would call the media and drop the AV with the supplied poto-chopped pics.

I would be laughing ’till May.

  30. renwa Says:

im so very sick of the stupid little ipod screens, hopefully the pictures weve seen are very similar to the new ipod. if its nothing compared to the picture there no chance im buying one.

if apple are bringing out another small screen peice of badness, they should take all these ipod av’s concepts to mind and creat something worth buying…

i wana see bluetooth headphones, flash drive, and the wide screen’s.

  31. baker02 Says:

I don’t care whats real or fake, if apple doesn’t model their next iPod video after the one on these so called fake pics, then apple needs to fire their product designers because this one looks fantastic. The beautiful widescreen, and touch-screen controls, makes the current iPod video look prehistoric!
